جولای 22, 2014نفقه:
نفقه از از ریشه انفاق به هزینه ها و مخارج و مایحتاج معاش اطلاق می شود که در ماده 1107 قانون مدنی تعریف و مصادیق آن احصاء شده است.
ضمانت اجرای عدم پرداخت نفقه:
ضمانت اجرای عدم پرداخت نفقه به دو دسته حقوقی و کیفری قابل تقسیم است:
شکایت کیفری با موضوع جرم ترک انفاق فقط در مورد نفقه زوجه صادق است آن هم فقط در رابطه با نفقه حال او.
در رابطه با نفقه گذشته او و نفقه اقرب فقط طرح دعوای حقوقی ممکن است.
ضمانت اجرای حقوقی به این صورت است که دعوا در دادگاه حقوقی خانواده محل اقامت خوانده مطرح می شود. در مورد نفقه زوجه دادگاه میزان نفقه را مشخص و زوج را به پرداخت آن محکوم می کند در صورت عدم اجرای آن از اموال شوهر پرداخت می کند و در صورتی که مال نداشته باشد زن حق طلاق خواهد داشت.
ضمانت اجرای کیفری جرم ترک انفاق در ماده 642 قانون مجازات اسلامی بدین شرح که هرکس با داشتن استطاعت مالی نفقه زن خود را در صورت تمکین او ندهد یا از تادیه نفقه سایر اشخاص واجب النفقه امتناع کند دادگاه او را از سه ماه و یک روز تا پنج ماه حبس محکوم می نماید.
تعقیب کیفری منوط به شکایت شاکی خصوصی است و در صورت گذشت وی از شکایت در هر زمان تعقیب جزایی یا اچرای مجازات موقوف می شود.
در آخر باید اضافه کرد کرد مشاوره و استفاده از وکیل متخصص در این زمینه در انجام این امر کمک شایانی خواهد داشت و در رابطه با مسائل مربوط به زوجین اعم از نفقه ، مهریه، اجرت المثل ، تمکین و از این قبیل امور استفاده از وکیل خانواده که به طور تخصصی در این زمینه فعالیت دارد باعث ایجاد سرعت و همچنین گرفتن نتیجه ی مثبت خواهد بود.

مهریه رو چه جوری دادگاه تعیین میکنه که بدم؟ اینکه قسط بانک دارم تاثیر داره توی کمتر دادن ؟ زندان هم دارم؟
وضعیت بچم چجور میشه؟پیش کی باشه ؟تا کی باشه؟ خرجش چهجور باید بدم ؟ دوریش از من چه جور میشه ؟
وضعیت وسایل خونه که خودم تهیه کردم و طلا هایی که خریدم چی میشه؟ وضعیت جهیزیه که آورده همسرم چی میشه؟
نفقه چه جوری باید بدم اصلا باید بدم چقد بدم ؟ مزنش چقدره؟
اصلا برای جدایی اینکه با اخلاقاش مشکل دارم میشه؟ واقعا بعضی وقتا خیلی اذیت میشم . بچم هم میبینه واسش خیلبی بده دعواهامونو میگم بیشترش 99 درصد لفظی هست.
