سفته چیست:
امروزه بسیاری از بانک و موسسات اعتباری، کسبه، افرادی که وام های آزاد می فروشند بجای چک، سفته هم قبول میکنند.
سفته را میتوان از دکه ها یا بانک ملی تهیه نمود.
ولی سفته همانند چک مراحل قانونی سختی را داشته و افراد با نشناختن ارزش سفته و ندانستن جایگاه سفته در قانون به مشکلات بسیاری دچار می شوند.
اجزای سفته چیست:
- نام و نام خانوادگی گیرنده وجه
- تاریخ پرداخت وجه
در صورتی که سفته برای شخص یا شرکت خصوصی مورد استفاده قرار میگیرد
باید دارای نام و نام خانوادگی شخص یا شرکت گیرنده در سفته مشخص گردد و در غیر این صورت باید در وجه حامل صادر گردد،
در صورتی که در سفته تاریخ درج نشود سفته به صورت عندالمطالبه در اختیار طلبکار قرار میگیرد و هر زمان در مراجع قانونی در خواست طلب را داشته باشد باید بلافاصله مبلغ سفته پرداخت شود.
سفته بدون نام طلبکار:
فرد طلبکار زمانی که سفته ای را جهت تضمین پرداخت مبلغ مقروضی خود صادر میکند، این شرایط وجود دارد که نام طلبکار را در برگه سفته قید نکند در این صورت فرد طلبکار میتواند سفته را به فرد دیگیری جهت وصول حواله کند.
نحوه پشت نویسی سفته:
پشت نویسی سفته همانند چک جهت وصول مبلغ سفته یا حوال کردن سفته به شخص دیگری صورت میگیرد.
سقف سفته:
هر برگ سفته دارای مبالغی جهت تضمین می باشند به این معنی که بر روی سفته اگر «ده میلیون ریال» درج شده باشد یعنی میتوان به اندازه یک میلیون تومان دارای اعتبار می باشد.
راه‌های وصول سفته:
برای وصول سفته میتوان از دو طریق اقدام کرد:
- از طریق اجرای اسناد رسمی: در صورتی که صادر کننده سفته به تعهدات قانونی خود عمل نکند دارنده سفته میتواند با مراجعه به دفتر اسناد رسمی اقدام به توقیف اموال و وصول طلب خود را وصول کند.
- از طریق مراجع قضایی دادگستری: در صورتی که صادر کننده ( بدهکار ) به تعهدات قاونی خود عمل نکند طلبکار میتواند با مراجه به مراجع قضایی و تنظیم دادخواست و دریافت مشاوره حقوقی جهت وصول طلب خود اقدام کند.
با توجه به مطالب فوق الذکر و اهمیت موضوعات حقوقی افراد متعددی جهت کسب اطلاعات حقوقی در زمینه دعاوی چک سفته الزام به تنظیم سند رسمی و … به موسسه حقوقی چتر عدالت ایرانیان مراجعه مینمایند .
